ERISAfire helps employers and insurance agencies manage compliance risk with proactive compliance reviews, comprehensive plan documents, annual government filings (including Form 5500, Form M-1, PCORI/Form 720, and ACA Reporting Forms 1094/1095), welfare benefits compliance consulting, and software solutions.

ERISAfire software solutions include a self-service plan document tool, Wrap+, and ERISAfire Projects. ERISAfire Projects gives employers and their account teams at-a-glance insight into upcoming compliance obligations and facilitates collaboration on compliance projects.

JOB DESCRIPTION

An ERISAfire attorney is affable and knowledgeable, offering practical (not just theoretical) legal advice. He or she will be advising clients on employee benefits regulatory compliance, focusing primarily on retainer clients.

The ideal candidate will have at least 5 years of legal experience in health and welfare benefits compliance—i.e., ERISA, ACA, HIPAA, COBRA, the Internal Revenue Code, and other laws pertaining to employee benefits. He or she must have excellent research and writing skills; be able to communicate findings and recommendations effectively (clearly, concisely and technically correct) both in writing and verbally; and the ability to manage multiple client deadlines simultaneously.

This position carries a billable hours requirement of 1200 hours annually.  Well below large firm standards, reflecting our commitment to sustainable, high-quality legal work and a healthy work-life balance.

JOB RESPONSIBILITIES

  • Stay apprised of legal and regulatory updates affecting health and welfare benefit plans including ERISA, ACA, HIPAA, COBRA, and the Internal Revenue Code
  • Advise employer and insurance agency clients on health and welfare benefits compliance questions
  • Welfare benefits compliance audits
  • Insurance and other benefits-related contract audits
  • Controlled group and affiliated service group determination
  • Maintain and update plan document templates
  • Plan document and Form 5500 quality review, issue related legal opinions
  • ACA penalty defense
  • Non-discrimination testing
  • HIPAA compliance training
  • Other duties as assigned
