3(16) Compliance Consultant

SetAway, LLC is growing — and we are looking for an experienced 3(16) Compliance Consultant to join our team.

This is a high-impact role that is critical to the continued success and growth of SetAway. The ideal candidate brings strong technical expertise in ERISA, IRS, and DOL regulations and takes pride in ensuring retirement plans are operated accurately and in full compliance.

At SetAway, relationships are key. We move quickly, solve problems, and support advisors and plan sponsors in a way larger firms often cannot. If you enjoy both the technical side of compliance and hands-on client support, this could be a great fit.

Key Responsibilities

  • Perform and review contribution calculations and required compliance testing 
  • Review and transmit IRS filings, including Forms 5500, 5558, and 5330
  • Review and approve plan documents, amendments, participant notices, and corrective actions
  • Ensure plan sponsors are operating in accordance with plan documents and applicable IRS and DOL regulations
  • Advise clients on plan design and recommend modifications to maintain compliance
  • Handle escalated payroll and contribution issues, especially for complex and large plans
  • Work effectively within bundled recordkeeper platforms 
  • Collaborate with business owners, financial advisors, accountants, and internal teams to resolve plan issues promptly
  • Coordinate with external auditors and support large plan audits
  • Research complex plan administration issues and develop appropriate correction strategies

Qualifications

  • 3–5 years of 401(k) plan administration experience with a strong compliance focus
  • Experience supporting large plans and complex environments
  • Hands-on experience working within bundled and unbundled recordkeeper platforms 
  • Experience with or exposure to 3(16) fiduciary services preferred
  • Solid understanding of ERISA, IRS, and DOL regulations
  • Experience with compliance testing software (ASC strongly preferred)
  • Strong analytical, organizational, and communication skills
  • Ability to manage multiple priorities and meet deadlines in a fast-paced environment
