Employee Benefits Attorney

The United Mine Workers of America Health and Retirement Funds (the Funds) has an immediate opening for an in-house attorney with experience in some or all of the following areas: qualified employer pension plans, employer health & welfare plans, labor and employment, litigation. The Funds is a group of six multiemployer plans that provide pension and health benefits primarily to retired union coal miners and their eligible dependents.   

The attorney’s principal responsibilities will involve providing legal advice to the Funds’ Trustees and staff regarding all aspects of administering an employee benefit plan.  Duties include, but are not limited to:

• researching legal issues and drafting memoranda regarding compliance with related statutes such as ERISA and the Internal Revenue Code, as well as issues involving Medicare compliance and HIPAA; 
• reviewing and providing advice on participants’ eligibility for benefits under the various plan documents and in accordance with the organization’s established procedures;
• drafting, reviewing, and interpreting contracts and other legal documents;
• representing the organization in litigation in federal courts; and
• assisting the organization with internal labor and employment issues.

Candidates should possess superior analytical and writing skills, be self-motivated and detail-oriented. Preferred candidates will have knowledge of ERISA and employee benefit plan documents, plus five years of related experience and/or training. Candidates must possess a law degree (J.D.) and bar admission.

Positions with the UMWA Health and Retirement Funds require COVID-19 vaccination subject to applicable state and federal law. Offers of employment for this position are conditioned upon the successful candidate providing proper proof of vaccination status prior to employment and pursuant to applicable law.
