The Compensation & Benefits Specialist (Specialist) will provide support to attorneys in the Employee Benefits and Executive Compensation (EBEC) practice group to assist the group in achieving its commitment to higher client care and goals of
efficiently and effectively serving its internal and external clients. The Specialist will provide guidance on specific areas of client work involving qualified retirement plans, health and welfare plans, and other compensation matters. The Specialist will
be a timekeeper in the EBEC practice group and report to the Office Administrator of the office in which the Specialist resides.
Essential Duties and Responsibilities:
- Monitor and apprise attorneys of legislative changes,
deadlines and trends affecting employee benefit plans
- Work with attorneys, legal assistants and others to maintain the group’s database of documents and other resources
- Monitor and update client plan document files and client project
tracker chart and ensure timely amendment of plans and compliance with IRS and DOL regulations
- Communicate with clients to obtain information required for plan amendments, regulatory filings, and audits
- Assist with preparation of client
alerts, year-end amendment charts and other client and business development matters
- Assist with basic legal research concerning plan design, regulatory requirements and administration
- Assist with preparing routine correspondence and various
legal documents, including, but not limited to, employee benefit plans, summaries, participant communications (SPD, SMM, safe harbor notice, 204(h) notice, etc.), board resolutions, and other legal or administrative documents for attorney
review
- Advise on corrections under the IRS correction programs including missed deferral opportunity, accumulated forfeitures, untimely adoption of required amendments, overpayments
- Assist clients with regulatory audits (IRS, DOL or
PBGC)
- Assist with preparing and filing governmental filings, including, but not limited to, IRS determination letter applications, Voluntary Correction Program submissions, excise tax returns for employee benefit plans, Form 5500 series annual
returns and attachments, top hat statements, Form M-1 for MEWAs, and Form 8950-SSA, and DOL submissions under the Delinquent Filer Voluntary Compliance Program and Voluntary Fiduciary Correction Program
- Analyze and advise on required
compliance testing (e.g., ADP/ACP, 415, coverage testing), including analysis of Separate Lines of Business for QSOLB qualification
- Review domestic relationship orders and power of attorneys
- Conduct compliance reviews of plan documents to
confirm compliance with regulatory requirements
- Perform other responsibilities as may be assigned from time to time
Knowledge, Skills and Abilities:
- Working knowledge of the design and operation of retirement
plans and some working knowledge of health and welfare plans
- Working knowledge of legal requirements applicable to retirement and welfare benefits (e.g., ERISA and Internal Revenue Code) required.
- Ability to exercise tact and discretion
involving sensitive and confidential matters
- Ability to work independently as well as on a team and collaborate effectively across the EBEC practice group in all offices
- Demonstrates excellent interpersonal skills to effectively interact
with all levels of firm personnel and outside clients and vendors
- Strong organizational skills that reflect the ability to perform and prioritize multiple tasks seamlessly with excellent attention to detail, even when under pressure
- Ability
to work and manage projects in a deadline driven environment
- Excellent written and verbal communication skills
- In-depth understanding of Microsoft Office suite is preferred, with an ability to quickly learn and utilize additional software
solutions
- Demonstrates a "can do" attitude and initiative to assist on a variety of projects
- Demonstrates a willingness to learn and develop skills
Education and/or
Experience:
- Bachelor’s Degree or any combination of experience and education that demonstrates the ability to perform the essential functions of the position.
- Licenses and certifications such as Certified Employee Benefits
Specialist (CEBS), Certified Pension Consultant (CPC) Enrolled Retirement Plan Agent (ERPA), etc. helpful but not mandatory.
