Responsibilities

This position is in the Office of the General Counsel (OGC), Multiemployer Law Division (MLD) of the Pension Benefit Guaranty Corporation (PBGC). MLD provides comprehensive legal services to PBGC respecting its insurance program for collectively bargained multiemployer pension plans.

PBGC protects the retirement incomes of over 34 million American workers and retirees in private sector defined benefit pension plans. OGC provides legal advice and counsel to PBGC on all legal issues it confronts, including enforcement of Title IV of the Employee Retirement Income Security Act of 1974 (ERISA) through litigation and negotiations; drafting regulations and guidance; deciding administrative appeals; administering PBGC’s compliance with the Freedom of Information Act; and advising PBGC on corporate governance, ethics, procurement, labor relations, and privacy.

When ERISA was enacted in 1974, Congress gave PBGC the authority to “sue and be sued, complain and defend, in its corporate name and through its own counsel, in any court, State or Federal.” Since that time, PBGC’s attorneys have ably represented the agency in thousands of court cases, bankruptcy proceedings, administrative actions, and transactions. PBGC’s litigators have helped shape the Title IV insurance program into an effective mechanism for insuring pension benefits and protecting the funds entrusted to PBGC.

Through focused strategic litigation in courts at all levels, including the Supreme Court, OGC has established precedent essential to the fulfillment of PBGC’s mission. OGC attorneys have represented PBGC in the nation’s largest bankruptcy cases, often serving a key role on the creditors’ committee. In that capacity, OGC has guided PBGC through structural changes in the U.S. economy and waves of bankruptcies in various industries.

The past several years have been turbulent for multiemployer pension plans, and MLD’s work has increased. Since the passage of the Multiemployer Pension Reform Act of 2014, MLD has been a critical component of PBGC’s implementation. Now MLD is providing PBGC advice and counsel on the implementation of the American Rescue Plan Act of 2021 (ARP). Some of the major duties of the position to be filled may include:

  • Advising PBGC on legal issues respecting multiemployer pension plans and PBGC’s insurance program for these plans. Such issues arise in the context of administrative determinations, litigation, negotiations, providing technical assistance to Congress, and developing regulations.
  • Investigating abuses of PBGC’s insurance program for multiemployer plans.
  • Advising and representing PBGC in litigation respecting multiemployer plans.
  • Drafting pleadings, motions, briefs, and other filings.
  • Negotiating with plan sponsors and other stakeholders and drafting agreements.
  • Assist in overseeing, managing, and coordinating the work of a legal team involved in the activities described above. Coordinate, review, and monitor the work of subordinate attorneys and provide oversight, direction, and guidance.

In the absence of any Division supervisor, the incumbent may provide direct supervision to the Multiemployer Law Division, as assigned by the Deputy General Counsel.

Qualifications

All qualification and eligibility requirements must be met by the announcement closing date.

You may start at a salary of between $144,128 and up-to $172,500 if you meet the following specialized experience by the closing date of the announcement (in addition to the education requirement).

Specialized experience is defined as at least one year of experience at the GS-14 grade level in the Federal service or equivalent to the GS-14 grade level in the private sector. This experience must include at least two of the following: (1) rendering legal advice under ERISA; (2) litigating significant cases; and (3) performing in-depth legal research and analysis.

Preferred Qualifications:
Preference will be given to applicants with a strong academic record and who demonstrate superior ability in legal research, analysis, and writing; in managing a large caseload; and in working as part of a team. Preference will also be given to applicants with experience rendering advice regarding multiemployer pension plans and the application of Title IV of ERISA to those plans, and to applicants with experience managing a team.

PLEASE NOTE: If you are currently serving or have previously served in the series in the Federal government for which this position is being advertised, you do not need to submit a transcript(s) if you submit an SF-50 that provides proof of you having been in the series.

Education

In order to qualify for this position, you must possess:
A J.D. degree from a school of law accredited by the American Bar Association.

Education must be completed at a College or University that has been accredited by an accrediting institution recognized by the U.S. Department of Education in order for it to be credited towards qualifications.

In addition to the education requirement, you must currently be an active member and in good standing of the bar of a state, a territory of the United States, or of the District of Columbia.
